Menu from Table Of Contents - Skip Chapter?

Hi Guys,
Is there a way to have the menu autogenerate from the table of contents, but not include the chapter? I'm trying to build a chapter level menu, but the menu object won't let me de-select the chapter when I choose sections in the chapter to be included in the menu when using the "Create menu from table of contents" feature.

I'm afraid you cannot include a subchapter and NOT include the parent chapter in the menu...
