Flash keeps pushing it.s way to the front

Ok, I am designing a course that has a help button. When the user presses the help button a diagram pops up explaining the navigation and what-not in the course. The image of the diagram is supposed to take up the entire content area. I have the help button set to toggle visible state on the help diagram. My help diagram is set for "always on top", and it is the only object set to "always on top". Everything works fine when I preview the course; the problem is when I publish to HTML. I have two pages which have flash content and I made sure that "always on top" was NOT check on either of the animations, but after the course is published to HTML when I press the button to open the help page, it opens behind the flash animations.
